  • La presente obra, aunque constituye un todo orgánico, tiene dos partes claramente diferenciadas: la primera parte es la teoría general de la sucesión y la segunda se subdivide a su vez en dos materias: la sucesión legítima, o sea aquella que se produce cuando no existe testamento, y la sucesión contractual dedicada a los pactos sucesorios. Todo ello se estudia no sólo bajo la óptica del Código Civil, sino también de las distintas legislaciones específicas #llamémoslas o no forales# que existen dentro de nuestro país; y que tan ricas son en algunas materias como éste, precisamente, de la sucesión paccionada, que el Código Civil la había ignorado totalmente (por lo menos hasta la reciente reforma del artículo 831) . Todas estas materias están claramente relacionadas no sólo por regular el hecho sucesorio, sino, también de manera negativa por no aludir a la sucesión testamentaria y dejar aparte la sucesión forzosa o legitimaria, hasta el punto de que incluso determinadas materias, como el derecho de representación, han sido encuadradas en uno u otro ámbito según los diversos autores que los han estudiado, y que han seguido un criterio racional o legal (atendiendo a la ubicación dada por el Código Civil). He tratado de actualizar a fecha de hoy #marzo 2007# la normativa y jurisprudencia existente sobre las diversas materias.
