  • RESUMEN: La idea de abordar el presente trabajo se hallaba en mi subconsciente desde finales del año 2000, fecha en que, en mi condición de letrado matrimonialista en Málaga terminé el que, sin duda, por muchos motivos (esencialmente sentimentales), supuso el pleito más duro que debí afrontar desde que me colegié en el año 1994 y cuyo origen se remontaba al verano de 1998: la separación y posterior nulidad matrimonial de un ser querido. Nunca antes había vivido desde dentro el sufrimiento que se siente como justiciable en esta materia tan dispersa en nuestra Jurisprudencia y muchas veces huérfana de un criterio unánime entre la judicatura, fruto de la falta de especialización en esta materia de los Tribunales Superiores, lo que ha dado lugar en numerosas ocasiones a que en localidades separadas por pocos kilómetros se dicten resoluciones dispares sobre presupuestos fácticos similares, lo que no hace sino generar desconfianza en el ciudadano e inseguridad jurídica en los operadores profesionales externos. Tras pasar por casi todas las fases de un procedimiento matrimonial (las antiguas medidas povisionalísimas #actuales medidas previas provisionales#, medidas provisionales, procedimiento de separación consensual archivado por falta de ratificación judicial del convenio, separación contenciosa y nulidad eclesiástica) el largo litigio terminó con un acuerdo alcanzado en ejecución de un Auto de eficacia civil de Sentencia canónica de nulidad matrimonial, que fue posible, como más adelante se expondrá, gracias a la posibilidad de esgrimir frente a la representación de la parte contraria la por aquellas fechas reciente Sentencia núm. 150/1999 dictada por el Tribunal Constitucional en esta materia, que a la postre facilitó alcanzar un acuerdo.
