Debate contemporáneo sobre el Trabajo Social Argentino y su proyección regional : Posibilidades y limitaciones -
RESUMEN: La idea de abordar el presente trabajo se hallaba en mi subconsciente desde finales del año 2000, fecha en que, en mi condición de letrado matrimonialista en Málaga terminé el que, sin duda, por muchos motivos (esencialmente sentimentales), supuso el pleito más duro que debí afrontar desde que me colegié en el año 1994 y cuyo origen se remontaba al verano de 1998: la separación y posterior nulidad matrimonial de un ser querido. Nunca antes había vivido desde dentro el sufrimiento que se siente como justiciable en esta materia tan dispersa en nuestra Jurisprudencia y muchas veces huérfana de un criterio unánime entre la judicatura, fruto de la falta de especialización en esta materia de los Tribunales Superiores, lo que ha dado lugar en numerosas ocasiones a que en localidades separadas por pocos kilómetros se dicten resoluciones dispares sobre presupuestos fácticos similares, lo que no hace sino generar desconfianza en el ciudadano e inseguridad jurídica en los operadores profesionales externos. Tras pasar por casi todas las fases de un procedimiento matrimonial (las antiguas medidas povisionalísimas #actuales medidas previas provisionales#, medidas provisionales, procedimiento de separación consensual archivado por falta de ratificación judicial del convenio, separación contenciosa y nulidad eclesiástica) el largo litigio terminó con un acuerdo alcanzado en ejecución de un Auto de eficacia civil de Sentencia canónica de nulidad matrimonial, que fue posible, como más adelante se expondrá, gracias a la posibilidad de esgrimir frente a la representación de la parte contraria la por aquellas fechas reciente Sentencia núm. 150/1999 dictada por el Tribunal Constitucional en esta materia, que a la postre facilitó alcanzar un acuerdo. -

Pues bien, otro vocablo español con partida de nacimiento gaditana es el de «asustaviejas», que designa una peculiar forma de acoso inmobiliario («mobbing» afirmarían los «cursis» del presente) que sufren, por lo común, inquilinos en edad de senectud o de vejez (los «cursis» del momento dirían «de la tercera edad», en detrimento de los nobles conceptos de «vejez» y de «senectud», que se consideran hoy en día antiguallas políticamente incorrectas), que se benefician de contratos llamados «de renta antigua», por lo general heredados de sus mayores, y en virtud de los cuales, por un módico precio, habitan desde tiempo inmemorial en viviendas envejecidas, muchas veces céntricas y señoriales mansiones, respecto de las que sus propietarios y otros especuladores más o menos oportunistas abrigan ávidamente el deseo de disponer del local o del solar para, previa renovación, obtener con su venta pingües beneficios. El tratamiento jurídico-penal que deban recibir los llamados «asustaviejas» es, desde luego, especialmente complejo. Y lo es no sólo por la intrínseca dificultad que supone el deslinde de algunos conceptos dogmáticos, como el «dolus malus» y el «dolus bonus», o —en la Dogmática penal reciente— el de los límites de los deberes de veracidad (¿hasta dónde debe informarse sobre el supuesto estado ruinoso de una casa? ¿cuándo el informe es información y cuándo incitación al abandono del local?), sino porque comúnmente la actuación de asedio inmobiliario bordea la ilegalidad en el seno de un concurso de delitos varios: estafas, coacciones (violentas o no), -

Una tecnopatía podría definirse como aquella afección que está estrictamente ligada a la profesión u oficio del trabajador, es decir, directamente relacionada con el elemento esencial del trabajo capaz de generar el daño. El presente escrito es producto del proyecto de investigación La Constitución de 1991 a quince años de su expedición. Análisis de su origen, desarrollo e impacto en la transición hacia una verdadera democracia, que fue financiado por la Pontificia Universidad Javeriana Cali, se desarrolló a partir de julio de 2006. La finalidad central del proyecto era indagar, a través de los testimonios de los constituyentes –los protagonistas principales–, por las circunstancias que rodearon el proceso de expedición de la Constitución que fue promulgada ese año. La actual configuración del derecho del mercado de valores como una realidad cada vez más cercana al mundo del crédito, es una realidad bien consolidada. La marcada y creciente proximidad entre las normativas vigentes del sector del mercado de valores y las disposiciones legales en materia de entidades de crédito, no parecen susceptibles de generar ninguna desavenencia o divergencia normativa de relevancia. En lo que respecta a la estructuración de la presente obra de la Profesora Rojo, la investigación tiene dos partes claramente diferenciadas, aunque interrelacionadas y complementarias: el estudio de una dimensión de mayor alcance, integrada por la observancia de las consecuencias jurídicas derivadas de la incorporación de la función intermediadora de las entidades de crédito en un mercado de valores regido por el principio de especialización, y el ensayo sobre un supuesto concreto, desde el análisis de la actividad colocadora efectuada por las mismas en las emisiones y O.P.Vs. De esta forma, al compartirse el mismo sujeto, se ponen enseguida de manifiesto las interrelaciones que se generan entre el mercado de valores y el bancario, como manifestación de la caída de las tradicionales fronteras entre los diversos subsistemas del mercado financiero, que hasta ahora se presuponían separados en compartimentos estancos.
