El presente estudio ofrece una síntesis entre la Teoría Funcionalista de la Traslación y los Estudios de Comunicación Intercultural. Cabe resaltar, no obstante, que son las aproximaciones traductológicas funcionalistas las que nos sirven de base para nuestra reflexión, es decir, la incorporación interdisciplinar de las teorías sociales e (inter)culturales se rige por nuestro interés prioritario, que es la traslación. Aunque la traslatología, como «interdisciplina» (Snell-Hornby [1988]1995 passim), recurre a otras áreas académicas, su carácter de disciplina autónoma requiere, a nuestro entender, que parta de conceptos propios, es decir, específicamente traductológicos, conceptos que, a su vez, definen el objeto de estudio y los intereses específicos de su área. De modo que los conceptos de otras disciplinas no se pueden aplicar sin más al campo de la traslación sino que requieren ser adaptados, según cada caso, a la perspectiva traslatológica (Holz-Mänttäri habla de «traslatologizar» [translatologisieren]; cf. p. ej., 1993a, 277 ; cf. Hönig 1995, 7 acerca de la autonomía de la traslatología; cf. también la discusión exhaustiva del desarrollo de la traslatología como disciplina autónoma y su relación interdisciplinar con otros ámbitos académicos en Kaindl 2004, 7-71) . Las ideas principales del enfoque que presentamos en adelante se basan en nuestro libro Die Kulturkompetenz des Translators. Begriffliche Grundlegung und Didaktisierung [La competencia cultural del traductor. Fundamentación conceptual y didactización] (Witte 2000 [22007]). Para la presente publicación hemos desarrollado en más detalle nuestra reflexión teórica anterior y ampliado la argumentación incorporando la bibliografía pertinente que ha visto la luz en estos últimos años. También se han añadido ejemplos prácticos, con el fin de facilitar el acceso a las ideas teóricas expuestas. Entendemos este estudio como una aportación a la Teoría Funcionalista (General; cf. cap. 1.3) de la Traslación, en el sentido de que los postulados acerca de la «competencia cultural del traductor» formulados en dicha teoría, aquí se ven precisados y concretados a través de la definición detallada de este concepto. -

La presente obra, aunque constituye un todo orgánico, tiene dos partes claramente diferenciadas: la primera parte es la teoría general de la sucesión y la segunda se subdivide a su vez en dos materias: la sucesión legítima, o sea aquella que se produce cuando no existe testamento, y la sucesión contractual dedicada a los pactos sucesorios. Todo ello se estudia no sólo bajo la óptica del Código Civil, sino también de las distintas legislaciones específicas #llamémoslas o no forales# que existen dentro de nuestro país; y que tan ricas son en algunas materias como éste, precisamente, de la sucesión paccionada, que el Código Civil la había ignorado totalmente (por lo menos hasta la reciente reforma del artículo 831) . Todas estas materias están claramente relacionadas no sólo por regular el hecho sucesorio, sino, también de manera negativa por no aludir a la sucesión testamentaria y dejar aparte la sucesión forzosa o legitimaria, hasta el punto de que incluso determinadas materias, como el derecho de representación, han sido encuadradas en uno u otro ámbito según los diversos autores que los han estudiado, y que han seguido un criterio racional o legal (atendiendo a la ubicación dada por el Código Civil). He tratado de actualizar a fecha de hoy #marzo 2007# la normativa y jurisprudencia existente sobre las diversas materias. -
